1. About Our Services

Bolulo Bobotle Marketing Agency (“we,” “us,” or “our”) is a domestic worker placement agency that connects employers with verified domestic workers, including helpers, nannies, cleaners, and caregivers. We operate primarily in Gauteng, South Africa, and source workers from Lesotho, South Africa, and Zimbabwe.

1.1 Our Role

We act as an intermediary placement agency. We:

  • Screen and verify domestic workers
  • Check references and documentation
  • Match suitable candidates with employers
  • Facilitate introductions and interviews
  • Provide guidance on employment arrangements

1.2 What We Are NOT

We are not:

  • The employer of the domestic workers we place
  • Responsible for paying workers’ salaries or benefits
  • A guarantor of worker performance after placement
  • Legal or financial advisors

2. Client Responsibilities

2.1 Employer Obligations

When you hire a domestic worker through our agency, you agree to:

  • Comply with all South African labor laws and regulations
  • Pay fair wages as agreed upon with the worker
  • Register workers for UIF (Unemployment Insurance Fund)
  • Provide appropriate working conditions and accommodations (for live-in workers)
  • Respect workers’ rights, including leave, rest days, and working hours
  • Treat workers with dignity and respect
  • Not engage in any form of abuse, harassment, or discrimination

2.2 Accurate Information

You must provide accurate and complete information about:

  • Your household requirements
  • Job responsibilities and expectations
  • Working conditions and arrangements
  • Compensation and benefits offered

3. Placement Fees & Payment Terms

3.1 Placement Fee

We charge a one-time placement fee for our recruitment and matching services. This fee covers:

  • Worker screening and verification
  • Reference checking
  • Documentation review
  • Candidate matching and interviews
  • Initial placement support

3.2 Payment

  • Placement fees must be paid before or upon successful placement
  • Fees are quoted individually based on service type and requirements
  • Payment methods will be communicated during consultation
  • Placement fees are separate from workers’ salaries, which are paid directly by employers to workers

3.3 Non-Refundable

Placement fees are generally non-refundable once a worker has been placed and has commenced work. However, we will work with you to find a replacement if issues arise within the first month (see Section 4).

4. Trial Period & Replacements

4.1 Trial Period

We recommend a trial period of 1-2 weeks for all new placements. During this time:

  • Both employer and worker can assess compatibility
  • Working arrangements can be adjusted
  • Either party may terminate the arrangement

4.2 Replacement Policy

If a placement does not work out within the first 30 days due to:

  • Compatibility issues
  • Worker performance not meeting reasonable expectations
  • Unforeseen circumstances

We will work with you to find a suitable replacement at no additional placement fee, subject to availability.

4.3 Replacement Limitations

Replacement services are NOT provided if:

  • The employer violates labor laws or mistreats the worker
  • The employer changes their requirements significantly
  • The worker leaves due to employer breach of agreed terms
  • More than 30 days have passed since placement

5. Verification & Screening

5.1 Our Verification Process

We make reasonable efforts to verify:

  • Worker identity and documentation (IDs, work permits)
  • Previous employment references
  • Work experience and skills
  • Basic background information

5.2 Limitation of Verification

While we conduct thorough screening, we cannot guarantee:

  • Absolute accuracy of all information provided by workers
  • Future behavior or performance of workers
  • That workers will meet all your expectations

Employers are encouraged to conduct their own additional verification and interviews before making final hiring decisions.

6. Liability & Disclaimers

6.1 Limited Liability

Bolulo Bobotle Marketing Agency is NOT liable for:

  • Worker performance, conduct, or behavior after placement
  • Any damages, losses, or injuries caused by workers
  • Theft, damage to property, or other incidents involving workers
  • Employment disputes between employers and workers
  • Non-compliance with labor laws by either party
  • Any issues arising after the placement has been completed

6.2 Employer Responsibility

Once a worker is placed, the employment relationship is directly between the employer and the worker. The employer assumes full responsibility for:

  • Supervision and management of the worker
  • Workers’ compensation and insurance
  • Any legal or financial obligations
  • Workplace safety and security

6.3 No Guarantees

We do not guarantee that:

  • A placed worker will remain in employment for any specific duration
  • Workers will perform to your exact specifications
  • Placements will be permanent or successful

7. Worker Registration & Information

7.1 Worker Data

Workers who register with us agree to:

  • Provide accurate and truthful information
  • Submit required documentation and photos
  • Allow us to share their information with potential employers
  • Update us on any changes to their availability or circumstances

7.2 Privacy & Data Protection

We are committed to protecting personal information. Worker and client data is:

  • Used solely for placement purposes
  • Shared only with relevant parties (workers with employers, employers with workers)
  • Stored securely and confidentially
  • Not sold or shared with third parties for marketing purposes

8. Termination of Services

8.1 Right to Refuse Service

We reserve the right to refuse or terminate services to any client who:

  • Violates these Terms and Conditions
  • Provides false or misleading information
  • Mistreats or abuses workers
  • Violates South African labor laws
  • Engages in illegal activities
  • Fails to pay agreed fees

9. Communication & Contact

9.1 How We Communicate

We communicate with clients through:

  • Phone calls
  • WhatsApp messages
  • Email
  • In-person consultations

9.2 Response Times

We aim to respond to inquiries within 1-2 business days. Placement timelines vary based on requirements and availability but typically range from 3-10 days.

10. Intellectual Property

All content on our website (bolulocare.co.za), including text, images, logos, and design, is the property of Bolulo Bobotle Marketing Agency. You may not:

  • Copy, reproduce, or distribute our content without permission
  • Use our name, logo, or branding without authorization
  • Scrape or collect data from our website

11. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be subject to the jurisdiction of South African courts.
